I don’t know how I feel about this. Anyone else?
David Phillips is a local artist who was commissioned by Fidelity to design a sculpture park near Fidelity Investments’ South Boston campus. About a year after he completed work on the project, Fidelity informed him that they planned on removing his sculptures and altering the park layout and design. They eventually relented, and agreed to keep most of the sculptures, but still planned on redesigning the park.
Phillips sued.
This week, the US Court of Appeals decided that Fidelity had a right to do what it wanted, in the park.
What do you think? Fidelity owns the land, owns the park, and commissioned the work. Should they have the right to do whatever they want?
Several laws have been passed over the past couple of years, protecting artists’ works, but Phillips work was not covered by them, apparently.
